Terms of Use

The agreement between you and the operator of THE HELM when you use the app.

Working draft — pending legal review. These terms describe the current product in good faith. The operating entity, governing law, liability terms and contact details are not final. Items marked [ TODO: LEGAL REVIEW ] will be completed before launch.

1. About these terms

These Terms of Use (“Terms”) govern your use of THE HELM, a mobile app for iOS and Android operated by [ TODO: OPERATOR LEGAL NAME ] (“we”, “us”). By creating an account or using the app you agree to these Terms. If you do not agree, do not use the app.

There is no browser version of THE HELM. This website is informational only.

2. Eligibility and your account

  • THE HELM is for adults. You must be at least 18 years old to create an account.
  • You are responsible for the account you create, for keeping access to your email secure, and for activity that happens under your account.
  • Provide accurate information (such as a display name that is not misleading or offensive) and keep it up to date.
  • One person, one account. Do not share or transfer your account.

3. Acceptable use

When using THE HELM, you agree not to:

  • break the law or encourage others to;
  • harass, bully, threaten, demean or abuse another person, in a Crew or anywhere else in the app;
  • post hateful, sexually explicit, violent or otherwise inappropriate content;
  • impersonate someone else or misrepresent your association with any person or organisation;
  • probe, scrape, overload, reverse engineer, or interfere with the service or its security;
  • try to manipulate XP, Doubloons, Bond, ranks, Voyages, challenges or Crew standings by any means other than normal play;
  • use automated tools to create accounts or generate activity.

4. Crew and social conduct

Crews are small accountability groups. A Captain leads a Ship; Shipmates are ordinary adult members. Membership controls what other members can see — your locked Today’s Watch, your reactions, your messages and your challenge activity.

  • Treat your Crew with respect. Encouragement and light banter are the point; cruelty is not.
  • A Captain may remove a member from their Ship. Leaving or being removed ends current membership and shared visibility, and preserves your personal progression.
  • We may act on conduct reported to us, including removing content or suspending accounts.

5. Your content

You keep ownership of the content you create in the app — habit names, messages, and similar. You grant us the limited licence needed to store, process and display that content to operate the service (for example, showing your message to your Crew).

You are responsible for what you post and confirm you have the right to post it. We may remove content that breaches these Terms.

6. XP, Doubloons and in-app values

  • XP, Career Rank, Doubloons and Bond are progression features inside THE HELM.
  • They have no monetary value, cannot be bought, sold, transferred, withdrawn or exchanged for money, and are not your property.
  • We may adjust, correct or reset in-app values to fix errors, abuse or balance problems. Highest earned Career Rank and its unlocked privileges are intended to be permanent within the current product design.

7. Availability and changes

THE HELM is offered “as is” and “as available”. It is under active development and currently in Beta. We may change, suspend or discontinue features, and we do not promise uninterrupted or error-free operation. We may update the app and these Terms as the product evolves; material changes will be notified by reasonable means.

8. Suspension and termination

You may stop using THE HELM at any time. We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or if we discontinue the service. On termination, your right to use the app ends. Account deletion is described on the Delete your account page.

9. Intellectual property

THE HELM — including its name, the Open Horizon mark, its artwork (including the Cabin, Polly and Wolly), its copy, its design and its software — is owned by us or our licensors and is protected by intellectual-property law. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. Do not copy, distribute or create derivative works from it without permission.

10. Disclaimers

THE HELM supports personal habits and accountability. It is not health, medical, psychological, financial or professional advice, and it is not a substitute for professional care. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some consumer guarantees cannot be excluded by law and are not affected by this section.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, progress or goodwill, arising from your use of THE HELM. Nothing in these Terms limits liability that cannot be limited by law. The specific liability cap and any consumer-law carve-outs are [ TODO: LEGAL REVIEW ].

12. Governing law

These Terms are governed by the laws of [ TODO: GOVERNING LAW / JURISDICTION ], and the courts of that place have non-exclusive jurisdiction. Final wording is [ TODO: LEGAL REVIEW ].

13. Contact
